A portion of those taxes are withheld from employees paychecks. These are considered to be held in Trust for the Internal Revenue Service. They take a very dim view of business people using funds withheld from employees paychecks for other purposes. We have found that once a business gets behind on their payroll deposits, it is very hard to catch them up. This creates a snowball effect and may soon spiral out of control. The penalties that the IRS assesses for failing to deposit payroll taxes and failing to file payroll withholding (940 and 941) returns are huge. For example, merely failing to file the 941 payroll withholding returns results in a penalty of 5% PER MONTH! Failure to deposit the payroll withholding also results in big penalties. It is ironic that if a business fails to pay its rent, the landlord will boot them out. If a business fails to pay for supplies, the supplier will cut them off. If a business doesn't pay its other debts, the creditors will be after them in short order. However, if a business doesn't make its payroll withholding deposits or file its returns, it might not hear from the Internal Revenue Service for years. When the IRS starts coming after taxpayers for past due Payroll Taxes, they can be ruthless. They often take the position that if a business can't pay its withholding taxes it shouldn't be in business. Collection efforts will result in seizures in short order. Personal responsibility of business owner. The IRS will look to the parties responsible for the withholding taxes individually. This means that the owners of the business may be responsible for the taxes that were withheld. This is true even though the business may be a Corporation or LLC. They will issue a Trust Fund Recovery Penalty proceeding against the owners. A professional needs to determine whether an owner is liable. For example, if that person had nothing to do with the finances of the company, they might not be liable. If you have payroll tax liabilities, you need legal help NOW! We can help!
