We have found that most Bankruptcy Attorneys do not fully understand the nuances of IRS Discharge in Bankruptcy, particularly after Bankruptcy Reform. To assist Bankruptcy Attorneys (and to make a little money ourselves) we offer the following services to you or your clients:
BANKRUPTCY ANALYSIS We will have your client sign an Authorization for Release of Information. The client will provide financial information. We will then obtain a transcript, year by year of the client's status with the IRS. This will tell us:
We can also obtain a transcript from the IRS showing all of the W2 and 1099 income reported as being paid to the client, year by year. This is often helpful if there are unfiled returns. We will then do an analysis of each years taxes and prepare a written opinion as to how much is Priority, how much is Secured and how much general Unsecured. We will also assist in calculating how much of the tax must be paid through a Chapter 13 Plan. Our fee for this service is $400 unless the client has been in business, has had employees and there may be Payroll Liability in which case the fee is $600. FULL TAX ANALYSIS In addition to a Bankruptcy Analysis, we can do a full tax analysis. This will include an analysis of whether the client qualifies for an Offer in Compromise, Non Collectible Status, Innocent Spouse Relief or other non Bankruptcy relief from their tax liability. There is an additional $200 fee for this service. In the Full Analysis we will also provide a detailed written analysis of the clients options and estimate approximately how much the client will have to pay in an OIC or other relief. The cost of a Full Analysis for individuals, including Bankruptcy Analysis is $500. If there are Payroll Taxes the fee is $750. This Service can be originated either by you, the Bankruptcy Attorney or by the client directly with us. We promise that we will keep you fully advised of the status. We will work diligently to provide the best solution to your clients IRS problems. We also will not represent your client in any other matters than we have been retained for. We will respect your relationship with your client. UNFILED TAX RETURNS Bankruptcy Reform has placed a great burden on Debtors. They must act promptly to get their returns filed or their Bankruptcy proceeding will be dismissed. Often debtors have several years of unfiled returns. They simply must get those returns filed. We can help. Our office has a full time Accountant employed with us. She has extensive experience preparing returns from limited information. Our office can obtain W2/1099 information directly from the IRS and get those returns done, filed and back to you promptly.
